1. Acceptance of Terms

By accessing, browsing, or using TextToVisualize ("the Service"), operated by Blazitek Solutions Inc. ("Company", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service constitutes your ongoing acceptance of these Terms and any future amendments.

2. Description of Service

TextToVisualize is an AI-powered platform that generates infographic images from user-provided text, URLs, or documents. The Service uses artificial intelligence models (including but not limited to Google Gemini and image generation APIs) to structure content and create visual representations. The quality, accuracy, and style of generated outputs may vary and are not guaranteed.

3. User Accounts

To access certain features of the Service, you must create an account. By creating an account, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately at support@texttovisualize.com of any unauthorized use
  • Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violations of these Terms.

4. Credits, Payments, and Pricing

The Service operates on a credit-based system. By purchasing credits, you agree to the following:

  • One-time purchases: Credits are purchased as one-time payments, not subscriptions
  • Credit consumption: Each infographic generation attempt that successfully produces an output consumes one (1) credit
  • Credits do not expire: Purchased credits remain in your account indefinitely, subject to account standing
  • All sales are final: Credits are non-refundable under any circumstances. Please see our Refund Policy for complete details
  • Pricing changes: We reserve the right to modify credit pricing at any time. Changes will not affect previously purchased credits
  • Account termination: Unused credits will be forfeited upon account termination for violation of these Terms

All payments are processed securely through Stripe. We do not store your payment card information directly. By making a purchase, you authorize Stripe to charge your payment method for the selected amount.

5. No Refund Policy

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. By purchasing credits, you acknowledge and agree that you will not be entitled to any refund, credit, or exchange under any circumstances, including but not limited to dissatisfaction with generated content, unused credits, account closure, or service changes.

The sole exception is a verifiable charge made in error (duplicate charge, incorrect amount) which must be reported within 7 days of purchase. See our Refund Policy for the complete no-refund terms.

6. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable content
  • Infringe on the intellectual property rights, privacy, or other rights of any third party
  • Distribute malware, spam, or engage in any fraudulent activities
  • Attempt to reverse engineer, decompile, or exploit the Service or its underlying technology
  • Use automated scripts, bots, or scrapers to access the Service
  • Circumvent or attempt to circumvent any usage limits, security measures, or access controls
  • Share your account credentials with third parties or allow others to access your account
  • Use the Service in a manner that could damage, disable, or impair the Service

Violation of these acceptable use terms may result in immediate account termination without refund of any purchased credits.

7. Intellectual Property

Your Content: You retain ownership of the original content you provide to the Service (text, URLs, documents). By submitting content, you grant us a limited, non-exclusive license to process your content solely for the purpose of generating infographics.

Generated Content: Infographics generated by the Service are AI-generated outputs. You are granted a non-exclusive, worldwide license to use generated infographics for personal and commercial purposes. We make no representations or warranties regarding the originality or copyright status of AI-generated content.

Our Service: TextToVisualize, its design, branding, features, algorithms, and underlying technology are and remain the sole intellectual property of Blazitek Solutions Inc. Nothing in these Terms grants you any right, title, or interest in the Service itself.

8. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate visual content. AI-generated outputs may contain inaccuracies, errors, or unexpected results. You acknowledge and agree that:

  • AI-generated content is provided "as is" without any guarantees of accuracy, completeness, or fitness for any particular purpose
  • You are solely responsible for reviewing and verifying all generated content before use
  • We are not liable for any damages, losses, or claims arising from your reliance on or use of AI-generated content
  • Generated content may not perfectly reflect your input or intentions
  • The quality and style of outputs may vary between generations

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted, timely, secure, or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control (including third-party API outages). We are not liable for any loss or inconvenience caused by Service downtime or unavailability. We do not provide any service level agreements (SLAs) or uptime guarantees.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT ANY GENERATED CONTENT WILL BE ACCURATE OR RELIABLE, OR THAT ANY ERRORS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLAZITEK SOLUTIONS INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY CANADIAN DOLLARS (CAD $50.00), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Blazitek Solutions Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; (d) any content you submit to the Service; or (e) any claim that your use of the Service caused damage to a third party.

13. Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or the Service:

  • Informal Resolution: You agree to first attempt to resolve any dispute informally by contacting us at support@texttovisualize.com. We will attempt to resolve the dispute within 30 business days
  • Binding Arbitration: If informal resolution fails, all disputes shall be resolved by binding arbitration administered in accordance with the laws of British Columbia, Canada. The arbitration shall be conducted in Vancouver, British Columbia
  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action
  • Small Claims Exception: Either party may bring qualifying claims in small claims court

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination: (a) your right to use the Service will immediately cease; (b) any unused credits will be forfeited and are non-refundable; (c) we may delete your account data in accordance with our Privacy Policy. You may terminate your account at any time by contacting us, but termination does not entitle you to any refund of purchased credits.

15. Modifications to Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We also reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Vancouver, British Columbia, Canada, and you consent to the personal jurisdiction and venue of such courts.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Blazitek Solutions Inc. regarding your use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals.
